An unprecedented move by an agency in the federal government, the Office of Thrift Supervision, urged their licensed banks to temporarily halt foreclosures. The Office of Thrift Supervision licenses federal savings banks and is directly under the Department of the Treasury along with the Office of the Comptroller of the Currency, which licenses national associations.
My foreclosure update:
My foreclosure lawsuit has been at a complete stand-still since September when the FDIC fraudulently transferred the case to federal court to avoid court-ordered mediation by the state of Ohio. Judge Katherine O'Malley denied my most recent motion to remand, pro se, whereby counsel was retained in November. We've been stuck since then. The Plaintiff, now Federal Deposit Insurance Corporation, made a bogus settlement offer to me in August, which included no cash. At the same time, FDIC claimed they needed 90 days to figure out how to settle with me, even according to court documents, so they motioned the court to stay the case. I called the court the same day and laid into a magistrate for them putting up with FDIC's lies, which is when the case was referred to mediation. Evidently, FDIC did not like the idea of mediation.
IndyMac Bank, F.S.B. (defunct as of July 11, 2008), my former bank, which failed to follow our contract, failed to release construction draws, charged me late fees every month possible, and messed up nearly every way possible was licensed under the OTS.
John Reich is still Director of the OTS. Sheila Bair is still Director of the FDIC. Michael Perry, founder of IndyMac and former CEO and President, has still not been indicted for fraud.
